Editors Note: These restrictive laws should be considered carefully before imposing on all business. We are tying to promote business yet restrict business with stricter regulations. It makes no sense in this struggling time for business to make things harder for them. Maybe lighting should be on a cases by case evaluation. The degree of lighting in a specific location differs and should not be considered universal. What do the businesses think? Their voice needs to be heard.
ORDINANCE NO. 17 -013 AN ORDINANCE AMENDING CHAPTER 155: SIGNS AS IT PERTAINS TO SECTION 155.09 PROHIBITED SIGNS (PERIMETER AND BORDER WINDOW LIGHTING)
This Ordinance has been published in pamphlet form 0n the ____ day of _______________, 2017, by the authority of the Mayor and the City Council of the City of Lockport, County of Will, State of Illinois. 2 ORDINANCE NO. 17 -013 AN ORDINANCE AMENDING CHAPTER 155: SIGNS AS IT PERTAINS TO SECTION 155.09 PROHIBITED SIGNS (PERIMETER AND BORDER WINDOW LIGHTING) WHEREAS, the Mayor and City Council of the City of Lockport have determined that the regulation of perimeter and border window lighting is essential for the creation of a consistent business climate, to eliminate the nuisances associated with this type of lighting, and reduce distractions for pedestrians and passing motorists;
and WHEREAS, this Ordinance makes necessary changes to the City’s Sign Code to prohibit perimeter and border window lighting. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOCKPORT, WILL COUNTY, ILLINOIS, AS FOLLOWS: SECTION 1: INCORPORATION OF RECITALS The recitals set forth in this Ordinance are incorporated in this Ordinance as Section
1. SECTION 2: AMENDMENT OF CHAPTER 155: SIGNS Section 155.09 Prohibited Signs of the Sign Code is amended to add the following provision as subsection (F): 155.09 (F) Perimeter or Border Window Lighting. Any form of lighting installed either internally or externally around the partial or full perimeter or border of a window to attract attention with illumination. This can include but is not limited to LED strip lighting, rope lighting, neon tubing or string lights.
SECTION 3: SEVERABILITY The provisions of this Ordinance shall be deemed to be severable, and the invalidity of any portion of this Ordinance shall not affect the validity of the remainder.
SECTION 4: EFFECTIVE DATE AND PUBLICATION This Ordinance shall be in full force and effect from the date of its passage and publication. The City Clerk of the City of Lockport shall certify the adoption of this Ordinance and shall publish the Ordinance in pamphlet form. Any property owner or tenant having perimeter or border window lighting on one or more windows shall have 30 days from receipt of written notice from the City to remove the noncompliant lighting.
