I am against the New Municipal Property tax voted in by Village Trustee’s Rodgers, Caprio, Gray, and Backel, which will be imposed on residents of Homer Glen. I certainly have a much bigger problem with the Homer Township Board suing The Homer Twp. Road district, or the Village of Homer Glen.
People who live in Homer Township also live in Homer Glen and in Homer Twp. Road District.
The Result of this lawsuit lead by Pam Meyers the Township Supervisor, and her Board Kalas, Offord, Kruczek, and Fijan will be paid by taxpayers from Homer Township, Homer Twp. Road District, and Homer Glen. If you live in Homer Glen you pay the attorney fees for both sides and if you you live outside Homer Glen you get to pay for attorney fees for only Homer Township and the Homer Twp. Road District.. Whoever wins will not affect the service you are getting right now, but how much of our taxpayer money will the lawyers get.
If the Twp. Road Commissioner Mike De Vivo did not offer Homer Glen control of the Road District none of this would be going on. There would be no first ever municipal property tax of $57 dollars per $100,000 of market value to business and homes in Homer Glen, or a lawsuit from the Township.
The Township did a referendum asking the people if the Homer TWP. Road District should be taken over by the Township Board which failed, keeping things the same. No mention of Homer Glen!!!!!!
Village of Homer Glen claims the people that voted No to giving control to the Township Board, wanted the Village to take over because they had public hearings and put it out that they wanted to take over the Road District. Problem is the people who voted no may or may not have wanted any take over by any entity. They may have just voted no to keep things the same. I was one of those people.
December 9th 2020, the Village Board voted to do the first municipal property tax. Pazmino and Sweas voted no. Rodgers, Caprio, Gray, and Backel voted yes.
Next we are told Homer Township headed by Pam Meyers is suing.
The same taxpayers these government entities represent are paying the cost of this lawsuit on all ends. Win or loose at this point is irrelevant because the only looser is the taxpayer.
Do the people we elected care about the taxpayer? I don’t think so. Their actions show they don’t.

Homer Twp sues Homer Glen over seizure of Twp Road District property

Homer Township, its public officials, and its residents filed suit today in Will County Circuit Court seeking a court order prohibiting the unlawful distribution of Homer Township Road District personal property and the unlawful jurisdictional transfer of Road District highways, all to the Village of Homer Glen.
The Village of Homer Glen, after the referendum to dissolve the Road District failed, announced it was seizing the Township Road District’s property and transferring highway jurisdiction to the Village.
After the current Road Commissioner, Mike De Vivo, attended a political caucus, and did not get slated, it is alleged that Vivo and the village decided to fast-track the seizure of the road district property to effectuate its transfer prior to the spring election, leaving the new, incoming road commissioner with no equipment with which to perform his duties.
Some of the allegations:
- Late last summer, the Village of Homer Glen informed Homer Township Supervisor Pam Meyers that it was going to seize the assets (equipment and real property) of the Homer Township Road District (“the Road District”) and that it had convinced the Township’s Highway Commissioner, Mike DeVivo, to simply give such assets to the Village through a transfer of “stewardship,” which is a term that the Village made up and not a process established by law.
- In exchange for the Highway Commissioner signing away these assets owned by the taxpayers, the Village would give him a job with the Village. The conveyance of all of the Road District’s assets to the Village would allow the Village to suddenly have a public works department that was subsidized, in part, by taxpayers in other jurisdictions.
- The Township knew there was no legal mechanism to abolish the Road District by, essentially, giving it away to the Village, but that if the electors of the Road District wanted to abolish it, they could do so by referendum.
- On November 3, 2020, the electors overwhelmingly voted not to dissolve the road district with a vote of 11,632 no votes (approximately 56%) to 9,127 yes votes (approximately 44%)
- Notwithstanding this vote, and in a deliberate and unlawful attempt to circumvent the will of the voters, the Village of Homer Glen and the Homer Township Highway Commissioner, Mike DeVivo, have fast tracked their efforts to gift the Road District‘s assets to the Village.
- This lawsuit seeks a declaration that such action is unlawful, and a permanent injunction to prevent the illegal transfer.
