As you know by now, Governor Pritzker’s mask mandate rule survived JCAR (Joint Committee on Administrative Rules) review on Tuesday.

All six Republicans on JCAR voted to suspend the rule, but we couldn’t get any of the Democrats to vote with us this time, allowing the rule to survive.

Back in May, Governor Pritzker made an unforced error by drafting a criminal enforcement administrative rule without consulting with the legislators from his own party. 

This time, he consulted with JCAR members and only filed his rule after making the changes necessary to gain support from the Democrats on the committee. 

That’s not illegal and it is the way JCAR does its business.What is unusual, however, is JCAR approving an administrative rule that conflicts with an existing statute.  That, coupled with Speaker Madigan and President Harmon refusing to provide any legislative oversight whatsoever on the Pritzker Administration is why I made the statement at the end of my radio interview.
“The legislative branch of Illinois Government is guilty of dereliction of duty.”
