HB3653 SAFE-T Act Law Effective January 1st

1.

Prohibits a custodial arrest for Class B misdemeanors such as trespassing, window

peeking, squatting, or loitering, which may only result in a citation, not the removal of the

trespasser.

2.

Any Class B or C Misdemeanor will result in a citation and not an arrest.

3.

Reduces possession of lethal 3g of heroin or methamphetamine from a felony to a

misdemeanor.

4.

Expands home electronic detention for the last 4 months serving sentences for Class

3 & 4 felonies, which need not be 24 hours or may not include electronic monitoring

devices.

5.

Eliminates cash bail and will automatically release anyone detained on January 1st,

2023 Who has not had a trial within 90 days of booking.

6.

Seven collar counties of Cook having 4,000-5,000

pretrial detainees, face release on January 1st.

Criminals can not be put in jail for crimes like kidnapping, aggravated battery, second-degree murder and more.
